Real Estate Photography
All Photos and rights relating to them, including copyright and ownership rights in the media in which the Photos are stored, remain the sole and exclusive property of Rosemary Kean. This license provides the limited right to reproduce, publicly display, and distribute the Photos only for promotional or advertising purposes directly related to the sale of the Property. Photos used for any purpose not directly related to the sale of the Property must be with the express permission of Rosemary Kean and the payment of additional fees, unless otherwise agreed to in writing. Client is responsible for ensuring that the Photos are removed from Real Estate listing sites such as Realtor.ca, and other MLS databases at the expiration of this Agreement.
Grant of rights is limited to a term of either one (1) year from the date of this Agreement, or (2) at the termination of Client’s representation of the Property, whichever occurs first. Further use of images beyond one (1) year requires Photographer’s permission and additional fees. Rights are assigned to the Client immediately upon delivery of the Photos.
This license is not transferable to another agent or third party.
Client will receive edited Photos within 36 hours of session, barring an emergency on the part the of Rosemary Kean. Client will be contacted should emergent circumstances arise and the 36-hour deadline cannot be met.
By scheduling an appointment with Rosemary Kean Photography, client agrees to the terms of service as listed above.
Client will receive an appropriate amount of photos to showcase the property properly.
A travel fee will be charged when the location is outside a 50 km radius of Photographer's residence in Kelowna, BC. That fee is $0.75 per km, each way, beyond 50 km.
Example: Location is 60 km one way: the travel fee is $15 additional as Photographer will be traveling 10 km beyond, and10 kms back to the 50 km mark.
Commercial, product, or art work license and print requests will be handled on a case by case basis dependent on usage. Please contact me for more details.
